Acceptance of Terms

These Terms of Service (Terms) govern your access to and use of eravolve.org and any related services provided by ERAVOLVE LLC (Eravolve, we, us). By accessing or using our website or services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site or services.

ERAVOLVE LLC provides software staffing and recruiting services, specializing in sourcing, screening, and placing top technology and software development talent to meet businesses’ IT and software staffing needs.

Eligibility; Accounts

You must be at least 18 years old to use our services.

Some features may allow or require you to submit forms or create an account. You agree to provide accurate information and to keep any credentials secure. You are responsible for activity under your account.

Services; No Guarantee of Placement

Our services include talent sourcing, screening, and placement for clients; and recruiting services for candidates.

We do not guarantee any specific results, such as a candidate’s placement or a candidate’s continued employment, unless expressly stated in a separate signed agreement.

Client Agreements and Statements of Work

If you engage us for staffing/recruiting services, the engagement may be governed by a separate master services agreement, statement of work, or order form. If there is a conflict between those documents and these Terms, the signed agreement controls.

Candidate Submissions and User Content

You may submit information such as resumes/CVs, profiles, portfolios, messages, and other materials (Content).

You retain ownership of your Content. You grant Eravolve a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, display, and share your Content as reasonably necessary to provide recruiting and placement services, including sharing with prospective employers/clients.

You represent that you have the rights to submit the Content and that it does not violate any law or third-party rights.

Screening; Background Checks

We may conduct screening activities as part of our recruiting process. If background checks or verification are required by a client or by law, they will be performed by authorized third-party providers with your consent and subject to applicable laws. Separate disclosures/authorizations may be presented to you.

Third-Party Services and Links

We may link to or integrate third-party tools (e.g., analytics, applicant tracking systems, background check providers). We are not responsible for third-party services. Your use of them is subject to their terms and policies.

Intellectual Property

The site and its content (excluding user-submitted Content) are owned by Eravolve or our licensors and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works.

Confidentiality

If you receive non-public information from us or our clients, you must keep it confidential and use it only for the intended purpose. We will treat your non-public submissions in accordance with our Privacy Policy and any applicable agreements.

Disclaimers

The site and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee accuracy, availability, or that the services will be error-free.

Limitation of Liability

To the maximum extent permitted by law, Eravolve and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, arising out of or related to your use of the site or services.

Our total liability for any claim is limited to the greater of $100 or the amount you paid to us for the services in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Eravolve and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the services, your Content, or your violation of these Terms.

Termination

You may stop using the site or services at any time.

We may suspend or terminate access at any time, with or without notice, if we believe you have violated these Terms or for operational or legal reasons. Upon termination, sections intended to survive (including 6–14 and 16–17) will survive.

Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules.

Binding arbitration: Except for small claims or injunctive relief, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association. You and Eravolve waive the right to a jury trial and to participate in a class action. Venue for any court proceedings will be the state or federal courts located in Georgia, and you consent to jurisdiction there.

Changes

We may modify the services and these Terms. Material changes will be indicated by an updated “Last updated” date and/or a notice on the site. Continued use after changes means you accept the updated Terms.
